  • Data Controller: Your personal data is processed by Wenatur GmbH in accordance with the General Data Protection Regulation (GDPR).

  • Data Processed: By participating in the relevant giveaway campaign, your Instagram username will be processed; if you are the lucky winner, your first name, last name, delivery address, and phone number will be processed for the purpose of shipping your prize.

  • Purpose and Legal Basis for Data Processing: This data is processed solely for the purpose of fairly concluding the relevant giveaway, determining the winners, and delivering prize packages to their owners via shipping, within the framework of legal contractual obligations (GDPR Article 6/1-b). The shared information will not be used for any other marketing activities or shared with third parties without the user's explicit consent.

  • Legal Participation Age and Eligibility: Participation in our giveaways is subject to a legal minimum age limit. Unless otherwise stated in the relevant giveaway post, only individuals who have reached the age of 18 and reside within the borders of Europe/Germany are eligible to participate. Participations from individuals below the specified age limit or employees of our company will be deemed invalid.

  • General Principles of Prize Content: The scope, quantity, and content of the prizes to be awarded as a result of the giveaway are as announced in the relevant Instagram giveaway post. It is not possible to legally convert the awarded prizes and gift packages into cash (Keine Barauszahlung möglich), exchange them for another product, or transfer them to another person.

  • Use of Third-Party Giveaway Tools: To ensure the process of determining giveaway participants is completely transparent, fair, and impartial, comments made under the post and usernames will be technically drawn and processed via a third-party digital giveaway tool/software (e.g., Simpliers, Wask, etc.). All users participating in the giveaway are deemed to have accepted in advance that their usernames will be scanned by these independent digital tools and transferred to the giveaway pool.

    Main and Reserve Winners:

    Determination of Main and Reserve Winners: In giveaways, "Main Winners" are determined for the number of announced prizes, and "Reserve Winners" are determined to prevent potential loss of rights. The prize rights of main winners found not to fully meet the participation conditions (follow, like, comment, etc.) will be canceled and transferred sequentially to the reserve winners.

  • Loss of Rights and Statute of Limitations: Winners who are notified of the giveaway results via our official account are required to provide their valid first name, last name, and delivery address information within the time granted to them (standardly within 48 hours unless a specific period is stated in the relevant post) to receive their prizes. Winners who do not respond within this period or provide incomplete/invalid addresses will lose all rights to the prize, and the right will pass sequentially to the reserve winners.

  • Data Retention Period: After the relevant giveaway process is fully concluded, main or reserve winners are announced, and prize packages are delivered to their owners without problems via shipping, all address, contact, and identity data collected within the scope of the giveaway will be completely and permanently deleted from our systems.

  • User Rights: Everyone participating in our giveaways has the right to request, by contacting us, the deletion, correction, restriction of processing of their data, or information about which data is processed (in accordance with GDPR).

  • Legal Exemption: The right to legal recourse (the right to initiate legal proceedings) regarding participation in this giveaway, the conduct of the giveaway, and the determination of winners is completely excluded (Der Rechtsweg ist ausgeschlossen).

  • Instagram Disclaimer: The organized giveaways have no commercial, sponsorship, or legal connection with the Instagram (Meta) platform. The giveaways are not supported, organized, or sponsored by Instagram. Participants agree that they provide their data to Wenatur GmbH as the data controller, not to the Instagram platform.

  • Campaign Conditions: The campaign period, prize content, and participation conditions (follow, like, tagging, etc.) are as explicitly stated in the Instagram post (in the description) for each giveaway. Participants must fully meet all specific conditions announced in the relevant Instagram post to win a prize. Giveaways are always concluded on the announced date and time; winners are announced on our official accounts.
